INSTRUCTIONS FOR REGISTRATION / RENEWAL
 OF ADVERTISERS IN M.C.D.
1.     Title
These instructions be called “The Instructions for Registration / Renewal of Advertisers in MCD” and shall come into force with effect from 31.10.2003.

2.         Competent Authority
For the purpose of registration of advertisers, Commissioner, MCD or any other officer duly authorized by him, shall be the Competent Authority.

3.         Applicability    
Any Indian individual, Sole Proprietorship Firm, Partnership Firm, Public Limited Company or a Private Limited Company, is entitled to get registered as an advertiser in MCD under these instructions, provided the eligibility criteria and other conditions are satisfied.  The registered advertisers shall have to abide by all the instructions made herein and as amended from time to time, during the currency of their registration.

3.1.    No individual or a firm having such individual as one of the partners, who is a dismissed MCD employee or black-listed or removed from the approved list of   advertisers or demoted to lower class, or having business banned / suspended by MCD in the past, or convicted by a court of law or declared insolvent or is a defaulter in making outstanding dues of MCD, shall be entitled for registration / renewal.

3.2.    No Advertisement Inspector or any other officer/official employed in the administrative duties in the Advertisement Department of the MCD, is allowed to work in the MCD either as advertiser or as employee of an advertiser for a period of two years, after his retirement from MCD service, unless he has obtained prior permission of the MCD to do so.  Even after registration, if either the advertiser or any of his employees is found to be such a person who had not obtained the prior permission of the MCD, as aforesaid, the name of the advertiser shall be removed from the list of registered advertisers.

3.3.    An advertiser is not permitted to have registration in more than one name.
 
3.4.    A partner of a firm or a director of a company registered as an advertiser, cannot be a partner/director in any other firm/company registered with the MCD as an advertiser.
 
4.    Scope
The registration of an advertiser in MCD shall only entitle him to be considered for issue of tender papers, subject to the conditions laid down in each individual Notice Inviting Tender, and shall not confer any right on him either to be necessarily issued the tender papers or for award of the work.

5.        Registration procedure
5.1.   The advertiser shall have to submit the Application together with Affidavit  and Indemnity Bond in the prescribed proforma (Annexures-1, II & III respectively) to the Competent Authority, complete with all documents as per Annexure-VI in the office of Advertisement Department, Room No. 206, Nigam Bhawan, Kashmere Gate, Delhi – 110006..

5.2.    The application form will be available in Advertisement Department, MCD, which  can be obtained on making a payment of Rs.1,000/- or as may be determined by the Commissioner, MCD, from time to time.  The application form can also be obtained through MCD website www.mcdonline.gov.in, for which the requisite fee shall be deposited by way of demand draft/pay order drawn in favour of Commissioner, MCD at the time of submission of the application .

5.3.    The application for registration & renewal would be considered twice a year; once between Ist to 15th January; and secondly between 1st July to 15th July.  After decision of the Competent Authority on the applications, the eligible registrants would be informed so as to make them eligible to participate in the programmes / tenders for the subsequent period.

5.4.    Incomplete application is liable to be rejected summarily.
5.5.   The Competent Authority shall have the right to independently verify the details furnished by the applicant and to get the works done by the applicant, inspected and/or to get such other reports as may be considered necessary.

6.     Registration No.

Every registrant will be given a Registration No. which should be quoted in every correspondence with the MCD.

7.Period of Registration
7.1.    The registration shall be valid for a period of one year.  The registration can, however, be renewed in accordance with these instructions.  Each renewal shall be valid for a period of one year from the date of expiry of the previous registration / renewal.  The registration shall be open to review by the competent authority and liable to termination, suspension or any other such action at anytime, if considered necessary, by the Competent Authority.

7.2.       The advertiser shall be governed by the provisions existing at a particular point of   time, irrespective of date of his registration.
    
8.         Eligibility Criteria
8.1.    The applicant shall have its registered office, preferably at Delhi / New Delhi  and in  case of firm / company having registered office in any other State / Union Territory, it must have its branch office at Delhi/New Delhi.  However, in case of a proprietorship concern, the Proprietor shall declare the complete office address in the same affidavit as required for the purpose of proof of constitution;

8.2.    The applicant shall have no outstanding dues of MCD on any account whatsoever;

8.3.    The applicant had never been black-listed in the past by the MCD;

8.4.    The applicant should not be a “Benami” one.

8.5.The applicant shall have to satisfy the minimum eligibility criteria specified in Table-I, before being considered for registration under any of the categories.

8.6.The financial soundness shall be adjudged on the basis of the documents as indicated under serial no. 6 of Annexure-VI.  

9.        Registration Fee/Security Deposit
At the time of application, the applicant shall have to pay a non-refundable registration fee as well as security deposit (refundable) prescribed for the category for which registration is being sought, by crossed Demand Draft/Pay Order drawn in favour of the Commissioner, MCD.  Fee for various categories is prescribed in Table-I.

10.    Change in Constitution
The registration shall not be transferable and any change in the constitution of the firm/company, on any account whatsoever, shall require prior permission from the MCD.

11.    Change in address
While applying for registration, the applicant should mention address of his   Registered as well as Head/Branch Office, if different.  

a.The advertiser shall intimate the change, if any, in any of the above addresses, in advance or maximum within one week of such change, subject to compliance of the relevant instructions.  Failure to do so may result in removal of his name from the approved list of advertisers.

12.    Renewal of Registration

12.1.The registration shall be renewable on year to year basis;

12.2.  The application for renewal would be considered twice a year; once between  Ist   to 15th January; and secondly between 1st July to 15th July.  The application for renewal will have to be filed in the Advertisement Department/MCD or through Internet (www.mcdonline.gov.in) in the prescribed form (Annexure-V) well before the expiry of the registration.  In case of failure to apply for renewal within the stipulated period, the registration shall stand automatically cancelled and the registrants shall have to apply for a new registration, on the expiry of the registration.

12.3The renewal shall be considered on merit and past record/performance of the advertiser and only after physical re-verification of his office address(es).

12.4.The renewal shall be allowed only after satisfaction of the competent authority.

13.Change of Category

13.1.Application for change of category shall also be considered twice in a year during the same period as determined in respect of registration / renewal.  In this regard, applications must be submitted in the Advertisement Department/MCD well in advance.

13.2.The application for change of category shall be submitted along with all the documents, as required for the first registration, subject to adjustment in registration fee & security deposit.

14.Revision of the Instructions

The Competent Authority may modify, add, delete and/or change any of the above instructions and the same shall be binding on all the registered advertisers.

15.Power to Relax

The Competent Authority may relax any of the requirements of these instructions in respect of registration / renewal of advertiser in the exigencies of work in the public interest for the reasons to be recorded.

16.Attestation of documents

Copies of all the documents to be submitted shall be self-attested by the applicant.  However, in the case of Proprietorship concern, the documents shall be attested by a Gazetted Officer or Magistrate.
 
17.Penal Action

The advertiser shall have to abide by all the relevant provisions of the DMC Act, Advertisement Bye-laws framed thereunder, orders/directions of the courts of law, Instructions for Registration/Renewal, the terms & conditions of the contract and also the Notice Inviting Tenders, as may be applicable.  The Competent Authority shall have the right to demote an advertiser, suspend business with him for any period, debar him or remove his name from the approved list of advertisers and/or black-list him, after issue of show cause notice.  The decision of the Competent Authority shall be final.  

18.   Repeal and Saving:-

All previous instructions regarding registration / renewal of advertisers in MCD existing before coming into force of these instructions, are repealed.  However, the advertisers already registered on the basis of instructions hither-to in force, shall be entitled to opt for registration in any of the categories, provided they apply in the prescribed application form under these revised instructions and deposit the registration fee as mentioned against each class in Table - I as well as the additional documents, by  05.12.2003 (which is also the last date for the receipt of application for new registration) and in regard to all other matters and further renewal of their registration, they shall be governed by these instructions.

19.   Arbitration

Any dispute arising in relation to the registration / renewal of advertisers, shall be referred to the arbitrator to be appointed by the Commissioner, MCD, in pursuance of the provisions of the Arbitration & Conciliation Act, 1996.

20.   Jurisdiction of Courts

         Any dispute will be subject to the jurisdiction of the Delhi courts only.

6.
Proof of financial soundness (column 5 of Table-I)

(a)Copies of the following documents:-

i)Income Tax Permanent Account No. (PAN) Card or proof of submitting application for PAN Card, of all the proprietor/ partners/ directors and also of the company /firm;

ii)Financial Statement of the firm/ company for the preceding three years (excluding or including the current financial year) showing the annual turn over not less than the amount, as prescribed in respect of the relevant category in column 5 of Table-1, duly certified by the Chartered Accountant;


iii)Balance sheet of the firm/ company for the preceding three years (excluding or including the current financial year) showing the annual turn over not less than the amount, as prescribed in respect of the relevant category in column 5 of Table-1, duly certified by the Chartered Accountant;

iv)Income Tax Returns of the firm/company for the preceding three years;

v)Details of bank account (as reflected in the I.T.Returns) with bank statement of the firm/company for the last 12 months.

b)   Surety Bond (in the prescribed format enclosed as Annexure-IV) to be executed by the owner of an immovable property having current value not less than that prescribed in column 6 of Table-1 against the relevant category, with (i) proof of ownership only in the shape of Sale Deed, Lease Deed, Conveyance Deed, Conversion Deed duly registered with the concerned Sub-registrar, Delhi; (ii) copy of PAN Card of the owner or the proof of submitting application for PAN Card; (iii) copy of latest Income Tax Return filed by the owner; and (iv) Valuation Report from a government approved valuer.
 
OR

A Bank Guarantee valid for a period not less than one year, in favour of Commissioner, MCD of the equivalent amount, as shown in column 6 of Table-1, to be renewed on year-to-year basis, at the time of annual renewal of Registration.




7.
Proof of authorization

      In case of company/partnership firm, a Resolution duly passed by the board of directors/partners thereby authorizing the signatory to sign and submit the application for registration and other documents, required for the purpose.








8.
Compulsory experience:-

i)  Copies of Service Tax Returns filed and bills raised, to show income from advertising business, for the last two years (in case of category "A"); and one year (in case of category "B").

ii) Copies of relevant MOUs/ Agreements /Work Orders relating to  advertisement business of the applicant firm.
